Privacy Policy
How we collect, use, store and protect your personal information, and the rights you have over it under the Protection of Personal Information Act.
1. Introduction
OKUHLE, trading as OHY Okuhle ("we", "us" or "our"), respects your privacy. This policy explains what personal information we collect through this website, our WhatsApp ordering process, and our TikTok and Facebook pages, why we collect it, how we use and protect it, and what rights you have.
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Where this policy refers to "personal information", it carries the meaning given to it in POPIA. This policy should be read together with our Cookie Policy and Terms & Conditions.
2. Who we are
| Responsible party | OKUHLE (OHY Okuhle) |
|---|---|

| WhatsApp / Phone | 076 198 1607 |
| Location | M70 Road, Mvundlweni, Pietermaritzburg, KwaZulu-Natal, South Africa |
3. What information we collect
Information you give us
- Order details — your name, WhatsApp/phone number, the items, sizes and colours you want, delivery or collection details, and anything else you tell us when placing an order via our Quick Order form, WhatsApp, TikTok or Facebook.
- Correspondence — the content of messages you send us on WhatsApp, TikTok, Facebook or email.
Information collected automatically
- Technical information — your browser type, device type and approximate region, collected by our hosting provider in ordinary server logs for security and reliability.
- Cookies and local storage — see our Cookie Policy. Nothing beyond what is strictly necessary is stored until you consent to it.
We do not ask for, and you should not send us, identity numbers, banking details, card numbers or other special personal information through this website or over WhatsApp. Where payment is arranged for an order, it is agreed and completed directly between you and OKUHLE outside of this website.
4. Why we process your information
| Purpose | Lawful basis under POPIA |
|---|---|
| Taking, confirming and fulfilling your order | Necessary to perform a contract with you, or to take steps at your request before entering one (s11(1)(b)) |
| Responding to questions sent via WhatsApp, TikTok, Facebook or email | Your consent (s11(1)(a)) |
| Keeping basic sales records for tax purposes | Compliance with a legal obligation (s11(1)(c)) |
| Protecting the website against abuse and spam | Our legitimate interests (s11(1)(f)) |
5. Direct marketing
We do not run an email or SMS marketing list. If we ever introduce one, we will only add you with your specific opt-in consent, separate from placing an order, and every message will include a way to opt out.
6. Who we share it with
We do not sell your personal information. We share it only where necessary, and only with:
- Delivery or courier partners — only the name, number and address needed to get your order to you, where delivery (rather than collection) is arranged.
- Our website and messaging providers — WhatsApp (Meta), TikTok and Facebook, which process messages you choose to send us under their own privacy terms.
- Authorities — where we are legally obliged to disclose information.
7. How we protect it
As required by section 19 of POPIA, we take reasonable technical and organisational measures to safeguard your information, including an encrypted (HTTPS) website connection and limiting access to order information to the people who need it to fulfil your order. No system is perfectly secure; if a security compromise affects your information, we will notify you and the Information Regulator as soon as reasonably possible.
8. How long we keep it
| Record | Retention period |
|---|---|
| Order and delivery details | Up to 5 years, in line with standard tax record-keeping requirements |
| WhatsApp / social media enquiries that don't lead to an order | Up to 12 months from your last message |
9. Your rights
Under POPIA you have the right to:
- Be told whether we hold personal information about you, and to receive a copy of it.
- Ask us to correct information that is inaccurate or out of date.
- Ask us to delete information we are no longer entitled to keep.
- Object, on reasonable grounds, to our processing of your information.
- Withdraw a consent you previously gave, at any time.
- Complain to the Information Regulator.
To exercise any of these rights, message us on WhatsApp or email ngoonairzie@gmail.com. We may ask you to verify your identity first, so we don't disclose your information to someone else.
10. Complaints to the Information Regulator
We would prefer to resolve any concern with you directly, so please contact us first. You are, however, entitled to complain to the Information Regulator at any time.

12. Changes to this policy
We may update this policy as our business or the law changes. The version published here is the current one, and the "last updated" date at the top shows when it last changed.
